Documents Required for Getting the Spice Board Registration

The application process and documents for getting the Spice Board Registration are given under Chapter IV as follows-

  • The application for grant of registration needs to be duly filed by the applicant to the Board in Form I.
  • The application for grant of registration shall be accompanied by the prescribed fee in form of a demand draft in the name of Spice Board.
  • A copy of the self-attested Import - Export Code Certificate (IE Code Certificate), that is also known as IE Code Certificate shall be made
  • The partnership deed or the Memorandum of Association (MoA) shall be submitted along with the Article of Association in self-certified form.
  • A copy of the PAN Card of the applicant shall be submitted in the self-attested form for verification purposes.
  • Self-attested copy of the Goods and Service Registration Certificate (GST Certificate)
  • The passport-size photo of the CEO or other designated officer needs to be submitted.
  • A copy of the Certificate issued by the Directorate of Industries needs to be submitted if the applicant does export manufactured spice products.

Process for Getting Spice Board Registration

The following steps need to be taken for getting the Spice Board Registration that is Certificate of Registration as Exporter of Spices (CRES)-

  • The first thing that the applicant needs to do is register their name under the Spice Board of India portal. For registering him/her on the portal, the applicant needs to submit the contact number, e-mail id, and Import-Export Code Certificate (IE Certificate Code). After the successful verification of those things, he/she can apply for filing the application form.
  • The applicant needs to file the export form which is form-1 along with the payment of the prescribed fee and tax payable in form of the demand draft in the name of Spice Board.
  • The form and fee shall be in the prescribed manner, otherwise, it will be rejected by the Board and the fee will not be refunded.
  • The application shall be submitted with some documentary evidence which can be a certificate or reference from the bank showing the financial status of the applicant
  • For verification purposes, all those submitted documents will be sent to the applicable Regional Office that is authorized under the Spice Board. If the Board finds any errors or faults then, it immediately asks the applicant to rectify them and re-submit the form again.
  • When the regulatory Authority gets satisfied, then they allot or issue the Certificate of Registration as Exporter of Spices (CRES) in Form 1 itself.

Grounds for Rejecting Application of the Spice Board Registration

There are some grounds on which the Spice Board can refuse or reject the application for the Spice Board Registration.

  • The Spice Board has the power to reject the application of the Spice Board Registration.
  • The Spice Board has the power to cancel the Certificate of Registration as Exporter of Spices (CRES) if the holder of the certificate has violated any of the rules and laws given regarding the certification.
  • The holder or the applicant will get the reasonable opportunity of being heard, before canceling such Application or the Spice Board Registration.
  • The Spice Board can also reject the certificate if it is against or not in the interest of the General Public.

Process for Renewing the Certificate of Registration as Exporter of Spices

The Certificate of Registration as Exporter of Spices (CRES) remains valid for the block period of three years. For renewing the Certificate, the individual needs to submit an application in Form -1 along with the prescribed fee to the respective authority. The individual needs to apply for renewal at the end of the block of the third year.

The applicants who wish to get the renewal of the certificate need to apply before 31st August, otherwise, after 31st August, the authority does not entertain or accept the application. Those who fail to apply for the renewal before the end of the block of three years need to pay the penalty for every month he has failed to do so.

The person who has not done any export spice business in the three years after getting the certificate, then he will not be able to apply for the renewal of the certificate. But if that person enters into any new export contract then he may apply for the new certificate.

The applicant who manufactures the spices in various forms needs to pay 15000 rupees and GST, while the applicant who only exports (merchant) the spices but does not manufacture spices needs to pay 10,000 rupees and GST if he wants to apply for getting the new registration.

But if the applicant has applied for renewal of the certificate, and if he is a manufacturing exporter, he needs to pay 10,000 rupees and GST and if he is the merchant then he needs to pay 7500 rupees and GST.

But if the applicant has applied for the amendments in the certificate, and if he is a manufacturing exporter, he needs to pay 5000 rupees a GST and if he is a merchant then he needs to pay 5000 rupees and GST.

Penalties for not holding Certificate of Registration as Exporter of Spices

It is mentioned in the Spices Board Act, 1986 that no person shall indulge in any spice-related business after the commencement of this Act without holding the Spice Board Registration. Hence, it is necessary to get the Certificate.

And if an individual indulges in any business related to the manufacturing of spices/ spice products, then that person will be liable for the following things.

  • That individual may get imprisoned which may extend till one year
  • That individual will be liable to pay a fine that may increase up to one thousand rupees.

Compliances Need to be Make After Getting Certificate of Registration

  • The certificate holder needs to submit the Quarterly Returns in Form B. The non-compliance of this results in a fine of rupees 500.
  • The application for a renewal certificate shall be made at least two months before its expiry period. If the certificate holder fails to apply for renewal, then he/ she needs to apply for a fresh certificate.
  • If the certificate holder does not carry any export of spices/ spice products during the block year of three years then it will result in the cancellation of the certificate,
  • If the certificate holder has made any changes with respect to the premises then he/ she needs to attest the same in the IE Code by the DGFT and it should be forwarded to the Board along with the Certificate for re-issue.
