Food safety and maintenance of food standard is the key requirement in a food business which is ensured by the FSSAI License. It can be a Basic, a State, or a Central license. State Food License in India ensures such food safety for the food business operators in their respective states. The procedure for obtaining a State Food License depends on the criteria the business fulfills. Although there are three types of food licenses, which are mentioned above, here in this writeup our focus is on the State Food License in India.
Food Safety and Standards Act, 2006
The Act provides for the root of India’s Food Safety and Standard Authority. The Act provides for laws relating to food and food safety, regulating their manufacture, storage, distribution, import and export, and availability of safe and secured edibles. The Act also regulates matters in connection to the standard of food and anything related thereto. Food is a very general thing that every citizen of India requires to survive or we can say that food is the basic need of every human being, hence providing security to food is mandatory for the safety of the citizen of the country. Therefore we can say that the Food Safety and Standard Act, of 2006 was a very good step taken by the Indian government regarding health security.
What is FSSAI?
The Food Safety and Standard Authority of India (FSSAI), is a government body regulating food safety in India. It has been established by the Ministry of Health & Family Welfare. Taking forward the need to have a regulated food safety authority in India, a network has been established to help with authentic information about food safety and related aspects. Products such as fats, oils, fruits and vegetable products, dairy products and many others have a prescribed standard given by the FSSAI.
FSSAI State Food License in India
Food Business Operators having a turnover of more than Rs 12 lakh per annum and less than Rs 20 crore per annum must obtain an FSSAI state license. Eligible FBOs like manufacturers, storage, transporters, marketers, distributors, etc. are required to mandatorily obtain a license from the State Authority. According to the FSS Regulations, 2011, the State Authorities operating are responsible for issuing a State Food License in each state.
Procedure for Getting a State Food License in India
Following are the steps are given below to obtain the State Food License-
Step-1: Filing of application Form B along with necessary documents.
Step 2: Submission of form through the online FoSCoS portal along with the standard fees.
Step 3: Examination of application and document by FSSAI’s officials.
Step 4: If found necessary, the FSSAI’s officials may conduct an on-site inspection to determine compliance at business premises.
Step 5: Grant of State FSSAI License. The application may be rejected or revoked if the authority is unsatisfied.
Following are the documents required for the State Food License in India-
- A completed and signed Form B.
- Passport-sized photos of the individual seeking the license.
- Applicant’s PAN card.
- Information related to all the members like Proprietor, Partner, and Directors such as their name, address, contact details, photo ID, etc.
- Details for all the plants and machinery that would be required.
- Details of food products to be manufactured.
- Authority letter to nominate the authorized person of the applicant.
- Sources of raw materials.
- Form IX by FSSAI.
- Proof of ownership of premises, if not available, a rental agreement in case of a rented premise.
- Import Export Code rendered by Directorate General of Foreign Trade.
- Management plans regarding the details of food safety.
- No Objection Certificate from municipal and local authorities.
Fees Required for State Food License in India
Fees required for State Food License in India are mentioned below in detail-
- Produce is more than 1MT per day – Rs 5000
- Produce is between 10.001 to 50,000 LPD of milk or 501 to 2500 MT of milk solids per annum – Rs 5000
- Produce is less than 1MT per day – Rs 3000
- Produce is between 501 to 10,000 LPD of milk or 2.5 MT to 500 MT of milk solids per annum – Rs 3000
- Hotel up to 4 Stars – Rs 5000
- All Food Service providers and other food Business Operators – Rs 2000
Penalty for not Complying with FSSAI’s norms
Non-compliance with any of the FSSAI norms may result in severe consequences. As per the FSS Act, 2006, an establishment is liable to experience penalties if there are discrepancies found during an audit. It may be as follows:
- Food quality breaches the compliance given in the act – 2 Lakh
- Petty manufacturer – 25,000/-
- Sub-standard food – 5 Lakh
- Misbranded Food – 3 Lakh
- Falsified advertisement or invalid description – 10 Lakh
- Inappropriate matter in food – 1 Lakh
- Manifesting non-corporation with Food safety officer direction – 2 Lakh
- Unhygienic processing or manufacturing of product – 1 Lakh
