Types of No Objection Certificate

No-Objection Certification from the Developer or Society 

To ensure that the property you are buying is debt-free, you must obtain the NOC from the society or the developer. When you buy a home using a bank loan, NOC is required. To transfer your property, you must present the NOC to society. 

Bank No Objection Certificate 

By taking out a mortgage on their home, builders finish their work. The builder needs to provide a NOC before taking out the loan. A bank cannot grant a mortgage to a builder prior to getting the NOC. 

As per RERA, a No Objection Certificate. 

According to section 15 of the RERA act, a promoter or developer must obtain the NOC from the 2/3rd of the allottees engaged in the project before transferring the rights and responsibilities of his property to a third party. 

Collector’s No-Objection Certificate (DM) 

To transfer the property, you must obtain the collector’s NOC in various states and regions. The lessor must obtain the NOC from the collector even while leasing the land. 

No Objection Court Administrator’s Certificate 

According to Indian Succession Act Section 307, an administrator may decide not to mortgage or transfer the real estate without the court’s previous approval. 

Documents Required for NOC Application 

Following are the documents required for the NOC Application, also this list is not exhaustive in nature.  

  • Certificate of Registration (RC) 
  • Certificate of Insurance[1] 
  • Permit and Certificate of Suitability (applicable to commercial vehicles) 
  • Certificate of Pollution Under Control (PUC) Lender approval of CMV Form 28 (if vehicle is covered by mortgage, HPA or lease) Lease 
  • Pencil imprint of VIN for Form CMV 28 
  • Photo ID and proof of address 

Procedure for No Objection Certificate
