  1. Prepaid payment instruments can only be issued by banks and Non-Bank Finance Companies that adhere to the Capital Adequacy requirement set forth from time to time by the Reserve Bank of India.
  2. Foreign Exchange Prepaid Payment Instruments: These regulations do not apply to organizations that are permitted by FEMA to issue foreign exchange prepaid payment instruments. The use of such payment instruments must adhere to the Foreign Exchange Management (Current Account Transactions) Rules, 2000, as modified, and be restricted to transactions that are permitted for current accounts.

Requirements of Online Payment Gateway

The following are the few requirements of Online Payment Gateway;

  • According to the Companies Act of 2013, any business requesting an online Payment Gateway License must be registered.
  • The company should have a minimum of two members or directors.
  • A company must have a detailed five-year business plan licenser to apply for the license.
  • Address verification for the transaction.
  • A business needs to register for a service tax number.
  • To apply for a license, the Software Certifying Agency’s code testing report is required.
  • According to the guidelines outlined in the Payment Card Industry Data Security Standard, the security for the online Payment Gateway must be optimized (PCI DSS).

Procedure 

To obtain a Payment Gateway License in India, the steps below must be taken:

Step 1: File an application in Form A by Section 5(1) of the PSS Act. The Chief General Manager of the Department of Payment and Settlement Systems at RBI’s Central Office in Mumbai, or any other office designated by RBI from time to time, must receive this application.

Step 2: According to Section 6 of the Act, the RBI has the discretionary authority to approve the license for the payment gateway. The RBI has the authority to conduct any inquiry that it deems essential. The questions will assist in establishing the veracity of the information provided by the application and examine the participants’ qualifications.

Step 3: Before approving a payment gateway, the RBI will verify the following conditions:

  • It is suggested to carry out the requirement for producing a proposal for a payment system or services.
  • The proposed payment system’s structure or the technical requirements established for the payment system.
  • The parameters under which the proposed payment system would operate, including any security measures.
  • The suggested method for carrying out the transfer in the specified payment system;
  • The required method of receiving instructions has an impact on payment system obligations.
  • The applicant’s moral character and financial situation.
  • The predetermined terms and conditions control how clients interact with payment providers.
  • The monetary and credit policy.
  • The time period for approval.

Step 4: If the RBI is satisfied that the applicant has met all of the requirements outlined in Section 7(1), it may grant the applicant an Authorization Certificate in Form “B” for the start and operation of a payment system. The authorization will go into effect on the date that the RBI specifies and under the terms that the RBI specifies.

Step 5: Under Section 4 of the PSS Act, the RBI[1] must process the authorization application as quickly as feasible, but not later than six months after the application was submitted.
