FSSAI License For Canteen

FSSAI( Food Safety and Standard Authority of India), established under the Food Safety and Standards Act of 2006, is a statutory body for protecting, supervising, and promoting food safety and ensuring avoidance of any irregularities in public health and hygiene. For any business related to food, for example, a canteen service, a license is required to be obtained by FSSAI. In this article, we will see all the aspects associated with the FSSAI license for canteen.

FSSAI license 

The FSSAI license, a food safety certificate, is issued by the FSSAI to all the food business operators pan India. Every food business requires a license from FSSAI, which will ensure food production safety and circulation of food products safely.

The FSSAI license is of three types:

  • State FSSAI license: Businesses with annual turnover between Rs 12 lakh to 20 crores can apply for a state license.
  • Central FSSAI license: Businesses with annual turnover above 20 crores can apply for a central license.
  • Basic License: Businesses with turnover below 12 lakh obtain basic licenses.

A Separate license is given to the food business based on different criteria.

FSSAI License for Canteen

Canteens are widely popular, especially among college students and office going people. Such businesses need to deliver quality food to customers, and thus, an FSSAI license for canteen is mandatory to meet the standard requirements for food safety. 

Eligibility criteria for FSSAI License for canteen

Following are the eligibility criteria for obtaining a basic certificate:

  • Business categorized as a food business with an annual turnover below Rs 12 lakh;
  • Cottage food industries;
  • Dairy units with a capacity of not more than 500 litres a day or up to 2.5 metric tons per year;
  • Food business involved in social or religious gatherings.

Following are the eligibility criteria for obtaining a state license:

  • Food business with an annual turnover between Rs 12 lakh to 20 crores;
  • Slaughter, meat processing units;
  • Rellaberers and Repackers;
  • Restaurants, Resorts, Hotels, vegetable processing units

Following are the eligibility criteria for obtaining a central license:

  • Food business with a turnover above 20 crores;
  • All the eligibility criteria for state license applies here in addition to the first criteria

Documents for FSSAI License for canteen

Followings are the necessary documents required for FSSAI license for canteen ( both state and central) :

  • Passport size photograph of the applicant/authority to be registered.
  • Self-attested Copy of PAN card of the applicant.
  • In the case of a partnership firm/ company, the firm/company’s PAN card is required.
  • Memorandum of Association/ Article of Association / Affidavit of proprietorship of the firm/company.
  • List of directors/members in case of a firm/ company 
  • Copy of registry of the company 
  • Rent deed of the premises of the business
  • List of equipment in the premise of the business
  • Residential Proof of the applicant
  • Residential Proof of the company/firm
  • In case the applicant is a repacker, relabeller, NOC from the manufacturer 
  • Form A or Form B, filled and signed by the applicant or the authoritative representative 
  • List of product details FSSAI declaration form
  • Any form of Government registration of business ( GST certificate/Trade license)
  • In case of State license, Copy of corporation license/ panchayat license/municipality license
  • Copy of Import export code certificate for the import-export product list
  • Authority letter from the company stating that the applicant is authorized to do so.
  • Photographs of manufacturing units
  • In the case of mineral water selling, water test report

Fees for FSSAI License for canteen

The fee for obtaining a license varies from Rs 100 to Rs 7500, depending upon the scale and type of business. The duration of the license varies from 1 to 5 years. Upon expiry, the license has to be renewed.

  • Rs 5000 is levied on the license with a validity of 5 years
  • Rs 4200 is levied on the license with a validity of 4 years
  • Rs 3400 is levied on the license with a validity of 3 years 
  • Rs 2700 is levied on the license with a validity of 2 years
  • Rs 2000 is levied on the license with a validity of 1 year
  • Fees for renewal application varies according to the year in case of state license
  • Rs 7500 is levied on renewal application of a central license/ improving license 

Penalties by FSSAI

Following are the various kinds of penalties in case of any irregularities:

  • In cases where the quality of the product is not up to the mark, the penalty can be up to 2 lakh rupees.
  • In cases where the food products are misbranded, the penalty can be up to 3 lakh rupees.
  • In cases where the business is spreading misleading information, the penalty can be up to Rs 10 lakh.
  •  In cases of non-compliance with FSO, the penalty can be up to Rs 2 lakh. 
  • In cases of unhygienic processing/manufacturing, the penalty can be up to Rs 1 lakh.
  • If the food contains non-necessary items, the penalty can be up to Rs 1 lakh.

Procedure for obtaining an FSSAI license for canteen

Following are the steps that need to be followed for obtaining an FSSAI license for the canteen :

Step 1: Submit an application of registration before the registering authority with the fee of Rs 100/-.

Step 2: Obtain a unique application reference number.

Step 3: The registration authority investigates the application. Upon investigation, the application is rejected/ accepted.

Step 4: After the application has been accepted, the business may be started, but the Registration authority might give notice of inspection 

Step 5: The inspection will take place within 30 days of the order, which is issued within seven days of the acceptance of the application

Step 6: After successful inspection, the license is issued by the registrar

It is essential to provide quality and hygienic food to the consumer. Non-compliance with the standards laid down by FSSAI[1] will attract penalties and jeopardize public health and safety. Some basic regulations have to be followed to get FSSAI registration for canteens.
