An eating house is a term used to denote a place where the public is admitted and where food and drink of all kinds are offered for lawful consumption. What is Eating House? 

Before talking about an Eating Food License, one must know about Eating Houses.  Eating Houses are those places where food and drinks are served to the general public for consumption. For example restaurants, bars, food shops, lounges where food and drinks are served, dhabas, etc.  The purpose of this license is to protect the general public from adulterated food. 

Procedure to get Eating House License Registration 

Following are the steps given below to get the Eating House License Registration in India- 

  1. The applicant must first register on the registration page of the official website of the police force in the state where the restaurant is to be established. The applicant receives a user ID and a password. 
  2. In the next step, fill out the license application and upload the required documents.
  3. After all documentation is submitted, the applicant must visit the State Additional Commissioner of Police for application and document review. 
  4. The applicant must then call the appropriate department to follow up on their application. If for any reason the application is denied due to incomplete information or bad faith, the government forfeits all fees paid. 
  5. Finally, a restaurant license will be issued to the applicant within 45-60 days, provided that the application and the documents submitted are reasonable. 

List of Documents Required for Eating House License Registration

Following is the list of documents to be uploaded with the application of the Eating House License Registration. List which is given below is not exhausted in nature. 


1. Documents Related to Site

  • Location of the eating house and its photographs. 
  • Fire safety certification.
  • The proof of surveillance system or CCTV.
  • Lease Agreement, Sale Deed or Rent Agreement. 
  • A NOC from the owner of the premises. 
  • Permission from the Indian Performing Right Society for DJ, live music, etc.

2. Documents Related to the Applicant

  • Identity Proof such as PAN Card, Voter Card, etc.
  • Proof of residence such as Passport, Bank Account, etc.
  • Memorandum of Association of Eating House. 
  • Company’s incorporation certificate.

3. Documents Related to Director and Employee

  • List of the names of all the directors with Form-32.
  • Identity Proof of all the directors.
  • For the operation of the business Resolution of the Board is required.
  • List of the names of all the employees who are working in the Eating House.
  • Identity Proof of all the employees who are working in the Eating House. 
  • Labour Departments’ certificate of registration is required. 

4. Other Related Documents- 

  • Trade License
  • FSSAI License
  • GST Registration Certificate
  • Provisional License, which works as a consent letter.
  • A Police Clearance Certificate, which is also known as PCC. 
  • Self attested certificate for the Eating House License. 

Eating House License Renewal

The license is renewed after the license period has expired. The validity of the license depends on the issuing authority; that is, the validity of the license varies from state to state. The license is usually valid for three years. The renewal process is similar to applying for a new license. 

Cancellation of Eating House License

If the applicant violates the guidelines issued at the time the license was granted or does not follow the instructions issued, the Authority may revoke the Cancel license after giving applicant a reasonable opportunity to be heard.  If the applicant wants to close the eating house for certain reasons, he can ask the authorities to issue the license. Accordingly, the authorities will revoke the license

Duplicate Eating House License

In case the license is torn, damaged or damaged, the applicant can apply for a duplicate license along with the prescribed fees. The authorities will examine the request and grant it. Restaurant license is one of the many licenses required to operate a food business in India. Getting the same is essential to running a legitimate business.

Declaration in Eating House License Renewal Affidavit

  1. Whether or not the eating house in question is operating in accordance with the Regulations; 
  2. Evidence of lease of premises attached or not;

  4. Whether or not the state government or police department issued a Red Corner Notice or Watch Notice against the premises in question; (This deals with property issues) 
  5. Whether or not the dining house complies with the Cinemas and Shows for Public Entertainment Regulations 1980; 
  6. Whether or not the eating house has followed the relevant safety measures in accordance with the applicable laws 
  7. Whether or not the eating house has adequate fire-fighting means and equipment; 
  8. Does the site have a clear route for evacuation according to regulations or not; 
  9. Whether or not the eating house operates in an authorized area; 
  10. Whether or not the venue has properly followed the capacity rules;
    Power connection status is valid or not; 
  11. Whether or not the facility has ensured compliance with child labour standards; 
  12. Whether or not the facility has background checks on the type of staff available; 
  13. Statement Acknowledging Workers’ Non-Involvement in Legal Crimes. 
  14. If the eating house has properly complied with COTPA Section 4 
  15. If the premises in question have complied with the regulations of the Pollution Control Committee 
  16. If the premises in question have received a Contamination NOC[1] from the department concerned 
  17. If the premises have been approved by the State Police of Delhi fined for violating underlying 
  18. Whether or not the venue installed the CCTV cameras in strategic locations;

The main objective of this license is to protect the food from adulteration and save the public from the consumption of adulterated food. It is a very good step from the government side to protect the food market in India. It is beneficial for the business holder as well as the government. Renewal of the Eating House License is an absolute mandate for the operation of the eating houses. A late or non-existent renewal could force the catering company to pay high penalties.
